Do you conduct workplace investigations or other administrative investigation functions? Are you looking to enhance your practice and develop practical skills? Join us for a unique opportunity in this hands-on, two-day workplace investigations training designed especially for lawyers in collaboration with the LESA.

Utilizing and expanding on established investigation principles, this course will address:

  • Principles of legally defensible investigations including investigator selection and biases, principles of natural justice and procedural fairness, and legal conflicts of interest.
  • Investigation planning and case management including techniques on how to clearly establish the scope and incidents and begin to plan specific areas of investigation and lines of questioning.
  • Trauma informed investigation interviewing including an understanding of trauma and its impact on issues of credibility, interview approaches, and the elicitation of maximum information.
  • Understanding person-on-person allegations of misconduct including an examination of the evolution of law and case law, and defining the elements related to harassment, bullying, sexual harassment, and human rights discrimination.
  • Investigating high conflict, querulous, vexatious, and dark triad personalities including how to identify dark triad personalities/high conflict persons and create strategies and techniques to investigate cases involving manipulation, deceit, and counter-allegations effectively and successfully.
  • Conducting credibility assessments including case law and the systematic application of ten credibility factors.
  • Investigation analysis and findings including the application of an analytical two-pronged test, balancing the probabilities, and coming to a definitive finding that withstands the highest level of legal scrutiny.

Working through a case study, the course will culminate in participants applying principles in mock investigation interviews, where they will assess credibility and come to legally defensible findings on the allegations. Online registration is available for the live broadcast only.
